GYM WAIVER AND RELEASE AGREEMENT

Location: Antonine Hub, Callendar Boulevard, Callendar Business Park, Falkirk, FK1 1XE
I, the undersigned, wish to use the facilities and participate in activities provided by Gym/Fitness Center Name. By signing this waiver, I acknowledge and agree to the following terms:
Assumption of Risk:
I acknowledge that using gym facilities, equipment, and participating in physical exercise involves inherent risks, including but not limited to physical injury, strain, discomfort, and the possibility of serious injury or death. I assume all risks and responsibility for any injuries or other medical incidents.
Waiver and Release:
I hereby release, waive, discharge, and agree not to sue the Provider, its employees, representatives, affiliates, or agents from any claims, demands, liabilities, rights, damages, expenses, and causes of action of any nature arising from my use of the gym facilities, whether caused by the negligence of the Provider or otherwise.
Medical Representation:
I represent that I am physically fit to use the gym facilities and participate in physical exercise. I have no medical condition that would prevent my safe participation. If I have any medical conditions or concerns, I have consulted with a healthcare provider and obtained clearance to participate.
Rules and Regulations:
I agree to abide by all rules, regulations, and policies of the Provider, including proper use of equipment, following safety guidelines, and respecting other members and staff.
Consent to Medical Treatment:
I hereby consent to receive any necessary medical treatment resulting from my use of the gym facilities and agree to bear all costs associated with such treatment.
Acknowledgment:
I have read this Gym Waiver and Release Agreement and the Terms & Conditions, understand their contents, and agree to be bound by their terms. I understand that I am giving up substantial legal rights by signing this document.
Antonine Fit Terms & Conditions
This agreement commences once your membership is confirmed, at which point a contract will come into existence between you and us.
You will be entitled to all the rights and privileges set for the membership you have chosen.
You cannot transfer this agreement to anyone else.
The first month membership fees are collected from you by us either by Debit / Credit card at time of purchase. Subsequent payments for monthly membership fees will be collected monthly thereafter. Each payment made is not refundable under any circumstances.
If any form of payment is not honoured for whatever reason we reserve the right to either suspend or terminate your membership.
You agree to advise us immediately of any change to the Members details provided.
Monthly Payments
From time to time we may need to increase the price of membership. We will give you at least 1 full months' notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase. During this period, you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with our notice.
Monthly Memberships
The minimum membership term is one calendar month commencing from your date of sign up. Once the minimum term is complete the membership will continue on a rolling payment notice.
You may terminate your membership at any point after the minimum term detailed above by cancelling your Credit or Debit Card payments with your bank, allowing 4 working days for the bank to action this. You will also be required to contact us directly by email on info@antoninehub.com to confirm that you are terminating your membership.
In the above circumstances your membership will remain in force until the day before your next payment is due, at which point it will terminate.
Access Fob Abuse Policy
Your Access Fob can only be used by you. This is issued solely for your use, as your membership is personal to you and only covers your use of a gym. You are responsible for keeping your Access Fob secure and confidential at all times.
Use of your Access Fob is monitored: In the interests of the safety and security of all our members, use of Access Fobs are monitored and individuals using Fobs may be asked to provide proof of identification.
What we will do if we think your Access Fob has been misused: Should we have reasonable grounds to believe that your Fob was used, with or without your knowledge and/or consent, by another individual or individuals, we reserve the right to take the following step : in the event of serious misuse of your Access Fob, for example, your Fob has been used on repeated occasions and/or by more than one individual we will cancel your membership with immediate effect, and no refunds will be given. We will notify you of this via email.
You will be required to pay a £10 refundable deposit for your fob at the beginning of your membership. If your fob is lost and a replacement is required then a further fee of £10 (non-refundable) will be applied.
CCTV
CCTV is in use in the gym and access doors. This is for safety and security.
Any individual recorded in any CCTV image is a data subject for the purposes of the Data Protection Legislation and has a right to request access to those images.
Any individual who requests access to images of themselves will be considered to have made a subject access request pursuant to the Data Protection Legislation. Such a request should be considered in the context of the Trust’s Subject Access Request Policy.
When such a request is made the appropriate individual with access to the CCTV footage will review the CCTV footage, in respect of relevant time periods where appropriate, in accordance with the request.
If the footage contains only the individual making the request, then the individual may be permitted to view the footage. This must be strictly limited to that footage which contains only images of the individual making the request. The individual accessing the footage must take appropriate measures to ensure that the footage is restricted in this way.
General Terms & Conditions
Members must be 16 or older.
If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
There may be occasions where we have to close all, or part of, the gym of which you are a member. We will do our best to let you know of such closures in advance of them taking place, unless the problem is urgent or an emergency. We will use all commercially reasonable endeavours to ensure that such closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part of, or all of, your membership fees in such circumstances.
We may terminate this agreement with immediate effect on notifying you if you are in breach of the Clubs Rules.
To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, wellbeing or physical condition. Further, that you will advise us immediately should your circumstances change.
